Residency Information A resident student is one who has been a legal resident in California for more than one year immediately preceding the beginning of the semester in which the student plans to enroll and who demonstrates the intent to remain a permanent California resident. A non-resident student is one who has not had a legal residence in California for more than one year immediately preceding the beginning of the semester. Such students are required to pay non-resident tuition in addition to enrollment fees until such time as California residency is established. To be reclassified as a resident, you must present documentation confirming that you have lived in the state for at least one year and one day prior to the first day of the semester. These documents should be submitted to the Admissions & Records office. Exemptions Exemption to the non-resident tuition exists when documentation is presented for any one of the following: AB 540 provides an exemption from nonresident tuition for students who attended a California high school for three or more years and graduated from a California high school or attained the equivalent thereof (GED or Certificate of High School Proficiency). In the case of a person without lawful immigration status, the student must sign an affidavit with the institution of higher education stating that the student has filed an application to legalize his or her immigration status, or will file an application as soon as he or she is eligible to do so. The exemption is not available for persons who are absent from California, but who are taking distance education classes from California community colleges. Students who are exempted from paying the nonresident tuition and are admitted under AB540 do not become residents for eligibility purposes for any state-funded program, such as the Board of Governors Fee Waiver (BOG) and the Extended Opportunity and Services Program (EOPS). For the Seasonal Agricultural Exemption the student must provide evidence that the student himself or herself or the student’s parents with whom the student is living earns a livelihood primarily performing agricultural labor for hire in California and has performed such labor for at least two months in each of the preceding two years.
